Who Needs Affirmative Action?

Executive Order 11246 (as amended by Executive Order 11375) requires federal contractors and subcontractors with contracts in excess of $10,000 to comply with Title VII and to take positive, results-oriented steps to eliminate employment barriers to women and minorities. This order prohibits discrimination on the basis of race, color, religion, gender, or national origin.

In addition, this order requires a written affirmative action compliance plan or program be implemented by all federal contractors or subcontractors with 50 or more employees who:

  • Have a contract of $50,000 or more
  • Have government bills of lading that, in any 12-month period, total $50,000 or more
  • Serve as a depository of government funds in any amount
  • Are financial institutions which are an issuing and paying agent for U.S. savings bonds and savings notes in any amount

Section 503 of the Rehabilitation Act of 1973 and Section 4212 of the Vietnam-era Veterans Readjustment Assistance Act of 1974 also require affirmative action programs and, thus, extend the employer’s affirmative action compliance plan to also include the disabled and protected veterans.
